BestHuman Terms and Conditions

These Terms and Conditions apply to coaching, mentoring, group programs, cohort-based learning, workshops, facilitation, digital resources, and related services provided by Locelle Digital Inc., operating as BestHuman (“BestHuman,” “we,” “us,” or “our”).By participating in a BestHuman program or using our services, you agree to these Terms and Conditions. If your employer or organization has entered into a separate agreement with BestHuman, that agreement may also apply. If there is a conflict between these Terms and a signed client agreement, the signed client agreement will govern.
1. Program Participation: BestHuman provides leadership development, executive coaching, mentoring, facilitation, and professional development services. Our programs are designed to support learning, reflection, leadership growth, communication, confidence, and workplace effectiveness.Our services are not medical, psychological, legal, financial, employment, or human resources advice. Participants are responsible for their own decisions, actions, and outcomes arising from their participation in any BestHuman program.Participants are expected to attend sessions prepared, participate respectfully, and engage in a way that supports a productive, inclusive, and safe learning environment for themselves and others.
2. Payment and Program Commitments: Payment is required upfront unless otherwise agreed in writing.
Coaching Programs:Coaching programs require a minimum three-month commitment. Once a participant has signed up and onboarding, matching, scheduling, or program preparation has begun, the participant is expected to complete the minimum three-month coaching commitment.If a participant cancels before onboarding, matching, scheduling, or program preparation has begun, they may be eligible for a refund, subject to any administrative costs, payment processing fees, or preparation costs already incurred.If a participant cancels after onboarding, matching, scheduling, or program preparation has begun, no refund will be provided for the minimum three-month coaching commitment, unless otherwise agreed by BestHuman in writing.
Mentoring Programs: Mentoring programs require a minimum four-month commitment, as they are designed as a complete program experience.Once a participant has signed up and onboarding, matching, scheduling, or program preparation has begun, the participant is expected to complete the full mentoring program.If a participant cancels before onboarding, matching, scheduling, or program preparation has begun, they may be eligible for a refund, subject to any administrative costs, payment processing fees, or preparation costs already incurred.If a participant cancels after onboarding, matching, scheduling, or program preparation has begun, no refund will be provided for the mentoring program, unless otherwise agreed by BestHuman in writing.
Employer-Sponsored Programs: For employer-sponsored programs, payment terms, cancellations, participant changes, refunds, credits, substitutions, and minimum commitments are governed by the agreement between BestHuman and the sponsoring organization.
3. Scheduling, Cancellations, and Missed Sessions1:1 Coaching or Mentoring Sessions: Participants are expected to provide at least 24 hours’ notice to cancel or reschedule a 1:1 coaching or mentoring session.Sessions cancelled or rescheduled with less than 24 hours’ notice will be billed in full and will not be rescheduled, refunded, or credited, except at BestHuman’s discretion.Missed sessions or no-shows will also be billed in full and will not be rescheduled, refunded, or credited.If a participant is more than 15 minutes late to a 1:1 session, the session may be treated as a missed session and billed in full.If a BestHuman coach or mentor needs to cancel or reschedule a session, the session will be rescheduled at no additional cost to the participant.
Group Sessions and Cohort Programs: Group sessions and cohort programs are scheduled in advance and are designed as a full program experience. Participants are expected to attend all scheduled sessions.If a participant misses a group session, that session will not be rescheduled individually, refunded, or credited.If BestHuman, the coach, mentor, or facilitator needs to cancel or reschedule a group session, BestHuman will make reasonable efforts to reschedule the session or provide an appropriate alternative.Repeated no-shows or lack of participation may result in removal from the cohort or program at BestHuman’s discretion. If a participant misses more than two sessions without prior notice, BestHuman may end that participant’s involvement in the program without refund or credit.
Corporate Workshops, Facilitation, and Custom Programs: For employer-sponsored workshops, private cohorts, off-sites, and custom engagements, cancellation and rescheduling terms may be outlined in the applicable client agreement, proposal, or statement of work.If no separate cancellation terms are outlined, BestHuman will make reasonable efforts to reschedule when possible. However, cancellations made close to the scheduled delivery date may be subject to full or partial charges based on preparation completed, facilitator time reserved, materials created, and other costs incurred.
4. Refunds and Program Cancellations: Refund eligibility depends on the type of program, the stage of participation, and whether the program is self-funded or employer-sponsored.For self-funded participants, the following terms apply unless otherwise agreed in writing:Payment is required upfront unless otherwise agreed in writing.Coaching programs require a minimum three-month commitment.Mentoring programs require a minimum four-month commitment.If a participant cancels before onboarding, matching, scheduling, or program preparation has begun, they may be eligible for a refund, subject to any administrative costs, payment processing fees, or preparation costs already incurred.If a participant cancels after onboarding, matching, scheduling, or program preparation has begun, no refund will be provided, unless otherwise agreed by BestHuman in writing.No refunds will be provided for attended sessions, missed sessions, no-shows, late cancellations, completed program components, digital materials already provided, or services already delivered.Sessions cancelled or rescheduled with less than 24 hours’ notice will be billed in full and will not be refunded, credited, or rescheduled.Missed sessions and no-shows will be billed in full and will not be refunded, credited, or rescheduled.BestHuman reserves the right to cancel, postpone, or modify a program if necessary due to facilitator availability, low enrollment, scheduling conflicts, technology issues, illness, or other circumstances.If BestHuman cancels a program and cannot provide a reasonable alternative, participants may be offered a credit, transfer, or refund for the unused portion of the program.
5. Confidentiality: BestHuman takes confidentiality seriously. Conversations between participants and their coach, mentor, facilitator, or cohort are intended to remain private and respectful.BestHuman coaches, mentors, and facilitators are expected to maintain confidentiality, subject to reasonable and legally required limits. Confidentiality may not apply where disclosure is required by law, where there is a risk of harm, where a participant gives consent, or where information must be shared for reasonable program administration.For employer-sponsored programs, BestHuman may share limited administrative information with the sponsoring organization, such as attendance, completion status, participation status, program engagement, or aggregated feedback. BestHuman will not share the detailed content of individual coaching or mentoring conversations with an employer without the participant’s consent, except where required by law or necessary to address a serious concern.Participants in group programs are also expected to respect the confidentiality of other participants. Personal stories, workplace examples, and sensitive discussions shared in a group setting should not be repeated outside the program without permission.
6. Participant Conduct: Participants are expected to contribute to a respectful, inclusive, and psychologically safe learning environment.BestHuman may remove a participant from a program if their conduct is disruptive, discriminatory, harassing, unsafe, disrespectful, or inconsistent with the purpose of the program.Participants must not record sessions, share private program materials, distribute confidential information, or use another participant’s personal or workplace information without permission.
7. Satisfaction and Program Fit:BestHuman aims to create meaningful and high-quality coaching, mentoring, and leadership development experiences.If a participant is not satisfied with their coach, mentor, group experience, or program fit, they should contact BestHuman as soon as possible. BestHuman will review the concern in good faith and may offer support, adjustments, a rematch, or another reasonable solution where appropriate.For 1:1 coaching or mentoring, BestHuman may offer a new coach or mentor match if there is a fit concern, subject to availability and program terms.For group programs, BestHuman will review concerns individually. Refunds, credits, substitutions, or cancellations are not automatic and will be handled in accordance with these Terms or the applicable client agreement.
8. Intellectual Property and Program Materials: All BestHuman program materials, including workbooks, assessments, templates, frameworks, slides, recordings, guides, exercises, digital resources, and platform content, are owned by BestHuman or used with permission.Participants may use program materials for their own personal and professional development. Participants may not copy, reproduce, distribute, sell, publish, teach, license, upload, or adapt BestHuman materials for commercial or public use without written permission.Participation in a BestHuman program does not transfer ownership of any BestHuman intellectual property.
9. Technology and Access: BestHuman may use digital tools, video platforms, scheduling systems, forms, email, and online portals to deliver services.Participants are responsible for ensuring they have the technology, internet access, and equipment needed to participate. BestHuman is not responsible for participant-side technical issues, internet disruptions, device problems, or missed sessions caused by technology limitations outside of BestHuman’s control.Participants must not share private login links, portal access, meeting links, recordings, or program materials with anyone who is not authorized to participate.
10. Testimonials, Feedback, and Marketing: BestHuman may invite participants to provide feedback, testimonials, survey responses, or success stories.BestHuman will not use a participant’s name, image, identifiable testimonial, employer name, or personal story for marketing purposes without consent.BestHuman may use anonymized or aggregated feedback to improve programs, report on outcomes, or describe program impact.
11. Privacy: BestHuman collects and uses personal information for reasonable purposes related to delivering and improving our services.This may include information such as name, email address, job title, organization, program registration details, scheduling information, coaching or mentoring preferences, assessment responses, survey feedback, attendance, communications, billing information, and information voluntarily shared during participation.BestHuman may use personal information to:deliver coaching, mentoring, workshops, and leadership development programs;match participants with coaches, mentors, or facilitators;schedule and administer sessions;provide participant support;manage billing, reporting, and client administration;improve our programs, services, and platform experience;communicate with participants about their program;request feedback or testimonials with consent;comply with legal, contractual, or regulatory obligations.BestHuman may share limited personal information with coaches, mentors, facilitators, contractors, service providers, payment processors, scheduling tools, technology providers, or sponsoring organizations where necessary to deliver the services.BestHuman uses reasonable safeguards to protect personal information. However, no method of transmission or electronic storage is completely secure, and we cannot guarantee absolute security.Participants may request access to or correction of their personal information by contacting BestHuman at:hello@besthuman.io
12. Third-Party Services and Links: BestHuman may use or link to third-party platforms, websites, tools, or services. These third-party services are not operated by BestHuman and may have their own terms, privacy policies, and security practices.BestHuman is not responsible for the content, privacy practices, security, or reliability of third-party websites or services.
13. Limitation of Liability: BestHuman, Locelle Digital Inc., its coaches, mentors, facilitators, contractors, employees, and representatives are not responsible for any decisions, actions, workplace outcomes, employment matters, business results, personal outcomes, or other consequences that arise from participation in a BestHuman program.Participants remain responsible for how they interpret and apply any ideas, feedback, coaching, mentoring, frameworks, or resources provided.To the maximum extent permitted by law, BestHuman’s liability is limited to the amount paid for the specific program or service giving rise to the claim. Nothing in these Terms limits any liability that cannot legally be limited or excluded.
14. Changes to Programs or Terms: BestHuman may update program details, schedules, facilitators, materials, delivery methods, or these Terms from time to time.Any material changes will apply going forward and will not affect completed services unless required by law or agreed in writing.
15. Governing Law: These Terms and Conditions are governed by the laws of the Province of British Columbia and the applicable laws of Canada.
